The following agreement is between Von Loos Dachshunds, hereby known as VLD, and [your name here], hereafter referred to as the “Buyer” for the sale and purchase of one purebred miniature longhaired dachshund. This contract represents the entire agreement between the two parties. No other agreements or promises, verbal or implied are included unless specifically stated herein. When VLD and the Buyer execute this contract, it will be binding upon both parties for the entire life of the dachshund, subject and according to the terms and conditions herein.
Basic Requirements
The Buyer must be at least 18 years of age. The Buyer must be prepared to take full responsibility for dog ownership for the duration of the dachshund's life (typical life expectancy 12-16 years), or the Buyer's life. The Buyer knows or has researched the dachshund breed and understands its traits and characteristics and believes it would be a good fit for this household. The Buyer agrees to maintain the dachshund’s health with regular visits to a licensed veterinarian and have the dog treated for parasites, and vaccinated according to veterinarian recommendations and/or requirements by law. The Buyer agrees to keep the dachshund in a humane and safe environment in accordance with all current and future state, county, and municipal laws and ordinances where the Buyer resides. The Buyer must keep the dog licensed which is mandatory in most states including Michigan.
Purchase Intentions
It is agreed between VLD and the Buyer that this dog is being purchased as a family companion and can also be used for tasks fitting to its breed such as a therapy dog, search and rescue, or AKC events within registration limitations. The Buyer shall not purchase a dog from VLD to resell, give to another person as a gift, or keep in a household other than their own. The dachshund shall not be sold, transferred, or given to any other individual, to any retail or wholesale establishment, or to any research institution where medical experimentation or other practices occur. The Buyer agrees that the dog will not be used in illegal activities such as dog fighting.
Health Guarantee & Refunds
The puppy has been evaluated by VLD’s licensed veterinarian and deemed healthy with all areas of evaluation being within normal limits (WML). Dew claws have not been removed at the recommendation of VLD’s veterinarian. The puppy is up-to-date on vaccinations and has been dewormed. A vaccination card and schedule will be provided by VLD on take-home day. VLD dachshunds come implanted with a pre-paid AKC microchip which includes non-transferable lifetime recovery service. However, when registering the microchip, the Buyer must enroll with AKC Reunite and list VLD as an alternate contact. The Buyer has 72 hours from the date of sale to have the dachshund examined by a licensed veterinarian of their choice, at their own expense. At this time the Buyer shall also discuss a flea+tick+heartworm prevention plan with their veterinarian, as 8 weeks is the earliest that some treatments can be started. If the veterinarian exam reveals that the dachshund has any life-threatening abnormalities or major concerns, the Buyer must inform VLD on the day of the office visit. The Buyer will then have the option of returning the dachshund to VLD immediately along with a written diagnosis from the licensed veterinarian in exchange for a replacement dachshund of equal value as soon as one becomes available or a full refund. VLD will not reimburse any veterinary or shipping/travel expenses. No full refunds will be made after 72 hours of pick-up and no veterinary bills will be paid by VLD. Genetic defects that are not life-threatening (such as a kinked tail) are not covered by this guarantee. Anything that occurs after pick-up (accidental injury, poisonings, loss/theft of puppy, etc.) is not covered by this guarantee.
Deposits & Non-Health-Related Refund Policy
Once a deposit has been made, the agreed-upon puppy status will change from Available to Reserved. The Buyer has a 48-hour grace period after placing a deposit to change their mind for any reason and receive a full refund. Refund requests must be in writing (email or text) within the 48-hour grace period. After 48 hours, the deposit is non-refundable unless Health Guarantee-related (see previous section). The Buyer may return the dachshund for any non-health-related reason within 72 hours after the purchase, provided that the dachshund has not been damaged or harmed in any way. The Buyer will then be entitled to a refund of the paid price, less the non-refundable deposit. After 72 hours, the Buyer may return the dachshund for any reason at any time for the duration of its life without a refund (see next section).
Surrender Agreement
The Buyer agrees that if at any time, and for any reason, they are unable to keep or properly provide a suitable home as per this contract, they will return the dachshund to VLD. The dachshund should not be rehomed, resold, or surrendered to a shelter or rescue under any circumstance. No refunds will be made if returning the dachshund to VLD after 72 hours of pick-up. The Buyer agrees to inform their family and/or Power of Attorney (if applicable) of this agreement. In the event of the Buyer’s death, VLD is always willing to take the dachshund back if no one is willing to take on the responsibility of caring for it. After returning the dachshund, VLD has full discretion to make future plans for the dachshund.
Spay/Neuter Agreement
VLD reserves the right to offer or decline breeding rights on any VLD dachshund. Unless other arrangements have been made with VLD, consider your dachshund as a companion pet only. Your dachshund will still be eligible for a Limited American Kennel Club (AKC) Registration (Learn more at https://www.akc.org/register/information/limited-registration/). Unless other arrangements have been made with VLD, the Buyer has no breeding rights with this dachshund in any form including but not limited to artificial insemination, cloning, harvesting the dachshund's sperm/ova, and/or genetic materials for the purpose of breeding/reproduction. Your dachshund will need to be spayed/neutered by the age of 9 months at the Buyer's expense. Proof must be provided to VLD within one month of the procedure and no later than one year of age. If the Buyer fails to provide VLD with proof by the deadline there will be a fine of $1,000 as a penalty for contract violation. Ovary-sparing spay or Vasectomy are recommended if your licensed veterinarian offers those hormone-preserving options. Hormones assist with proper growth and development, lessening the risk of IVDD, weight gain, and coat changes in Dachshunds. Removing the ability to reproduce while preserving the hormones is the most ideal scenario.
AKC Registration
VLD guarantees that the puppy is a 100% purebred miniature longhaired dachshund. VLD certifies that the dachshund is eligible for registration under the regulations of the AKC as a purebred dachshund and will provide the proper forms for such registration. At a minimum, all VLD dachshunds will be eligible for Limited AKC Registration. At the discretion of VLD, some dachshunds may be eligible for Full AKC Registration for an additional $500 of the purchase price.
Pick-up Agreement
Puppies must be picked up on the agreed-upon take-home day, typically at 8 weeks of age or shortly thereafter, and no later than 10 weeks of age. After 24 hours from the agreed-upon pick-up date, if no communication from the Buyer has been made, the puppy shall be considered abandoned and shall remain the sole property of VLD. The deposit will be forfeited and no refund will be issued. Should a family emergency or change in circumstances arise prior to the agreed-upon pick-up date, other arrangements may be made. If the Buyer communicates and makes other arrangements with VLD, the pick-up date may be adjusted and/or the deposit may be transferable to a different puppy at the discretion of VLD. Any transfers will be at VLD's discretion. If a transfer of deposit is offered by VLD, it will be valid for two years from the date the original deposit was received.
Release of Liability
The Buyer agrees not to sue VLD and the Buyer agrees to pay any and all court or attorney fees incurred by VLD should any suit be brought against VLD regarding this dachshund by any person. Should the dachshund become ill or injured, any and all costs of treatment will be the responsibility of the Buyer. VLD is not liable for any further costs of any kind associated with this dachshund and, that this term shall be binding for the entire life of the dachshund unless it is surrendered back to VLD. The Buyer understands that any violation of the terms outlined in this contract will constitute a breach of contract and will result in legal action(s) being commenced against the Buyer. It is agreed that the place of venue for any legal dispute between the Buyer and VLD will be Shiawassee County, Michigan.
